Terms of Use

1. Acceptance of Terms
These Terms of Use ("Terms") form a binding legal agreement between you ("User", "you", "your") and SGCharity.sg ("we", "us", "our"), the operator of the website at sgcharity.sg (the "Platform"). By accessing, browsing or otherwise using the Platform, you acknowledge that you have read, understood and agreed to be bound by these Terms in their entirety, together with our Privacy Policy, which is incorporated herein by reference.
If you do not agree to any part of these Terms, you must immediately cease using the Platform.
2. Eligibility
You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use the Platform. By using the Platform, you represent and warrant that you meet this requirement and have the legal capacity to enter into binding agreements under the laws of the Republic of Singapore.
3. Nature of the Platform
SGCharity.sg is an independent, non-commercial information aggregator and directory that compiles publicly available information about charities, religious organisations and Institutions of a Public Character ("IPCs") operating in Singapore. The Platform is provided as a community resource to facilitate informed giving across faiths.
SGCharity.sg expressly clarifies that it:
- is not a registered charity, charity organisation or Institution of a Public Character under the Charities Act 1994 (No. 22 of 1994) of Singapore;
- does not solicit, collect, receive, process, handle, hold, transmit, transfer or facilitate any donations on behalf of any charity or person;
- does not operate any payment gateway, donation processing facility or fund-raising mechanism;
- does not act as an agent, representative, trustee, fiduciary, fund-raiser or appointed party for any listed charity or third party;
- does not endorse, recommend, vouch for, certify or guarantee the legitimacy, integrity, financial position, governance, programmes or activities of any listed organisation;
- is not a licensed financial adviser, tax adviser, legal adviser or fund-raising agent.
The Platform's sole function is to present publicly available information and to redirect Users to the official websites or donation pages of the respective listed organisations. All donations are made directly between the User and the chosen charity, under that charity's own terms, policies and processes.
4. Information Accuracy and Disclaimer
All information published on the Platform is compiled from publicly available sources, including but not limited to the Singapore Charity Portal (charities.gov.sg), the Accounting and Corporate Regulatory Authority ("ACRA"), the Inland Revenue Authority of Singapore ("IRAS"), official charity websites, annual reports, news media and other public records.
While we make reasonable efforts to ensure that information is accurate, current and complete, we make no warranty, representation or guarantee, whether express or implied, as to the accuracy, completeness, timeliness, reliability, suitability or fitness for any particular purpose of any information published on the Platform. Information may be inaccurate, incomplete, outdated or superseded by subsequent events.
You are solely responsible for independently verifying the current charity registration status, IPC status, bank account details, donation procedures, governance and any other material information of any charity directly with the charity itself or via the official Charity Portal at charities.gov.sg before making any donation, transfer of funds or commitment of any kind.
5. No Financial, Tax or Legal Advice
Nothing on the Platform constitutes financial advice, tax advice, legal advice, investment advice or any form of professional advice. Information regarding IPC status, tax deductibility, donation matching, governance scores or any other matter is provided for general informational purposes only and should not be relied upon as the basis for any decision. You are advised to consult a qualified professional adviser before making any decision based on information found on the Platform.
6. Anti-Scam Advisory
SGCharity.sg will NEVER:
- request your bank account login details, internet banking credentials, One-Time Passwords (OTPs), Personal Identification Numbers (PINs) or any payment credentials;
- solicit donations, payments or transfers of any kind through SMS, WhatsApp, Telegram, instant messaging applications, telephone calls, voice messages or any unsolicited communication;
- contact you directly to request that you transfer money to any bank account, PayNow number, cryptocurrency wallet or other payment channel.
Any communication purporting to be from SGCharity.sg that requests such information or actions is fraudulent and should be disregarded. If you receive a suspicious communication or believe you have been targeted by a scam, you should:
- call the Singapore Police Force at 999 in the case of an emergency;
- call the 24-hour ScamShield Helpline at 1799 for advice;
- report the incident to the Singapore Police Force at police.gov.sg/iwitness or via the ScamShield mobile application.
7. Intellectual Property Rights
All original content on the Platform, including but not limited to the SGCharity.sg name, logo, design, layout, structure, source code, written editorial content and curated compilation of information, is the property of SGCharity.sg or its licensors and is protected under the Copyright Act 2021 (No. 22 of 2021), the Trade Marks Act 1998 (No. 46 of 1998) and other applicable intellectual property laws of Singapore.
Information derived from public sources (including the Singapore Charity Portal, ACRA, charity annual reports and media reports) remains subject to the terms, conditions and copyright of those original sources. The presentation, organisation and editorial selection of such information on the Platform constitutes our original work and is protected accordingly.
You may not reproduce, distribute, publish, transmit, modify, adapt, translate, create derivative works from, publicly display, sell, license, sublicense or otherwise commercially exploit any portion of the Platform without our prior express written consent. Limited personal, non-commercial use, such as printing a single page for personal reference or sharing a link, is permitted.
8. Permitted Use and User Conduct
You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Platform by any third party. In particular, you agree not to:
- use the Platform for any unlawful, fraudulent or malicious purpose, or in violation of any applicable Singapore or international law;
- attempt to gain unauthorised access to any part of the Platform, its server, its database or any system or network connected to the Platform;
- use any automated means (including bots, spiders, scrapers, harvesters or similar tools) to access, copy, monitor or extract data from the Platform without our prior written consent;
- introduce or transmit any viruses, malware, ransomware, trojans, worms, logic bombs or other malicious code or material;
- interfere with, disrupt, or attempt to bypass the security, integrity or operation of the Platform;
- impersonate any person or entity, or misrepresent your identity or affiliation with any person or organisation;
- use the Platform to harass, abuse, threaten, defame, stalk or otherwise violate the legal rights (including rights of privacy and publicity) of any person;
- collect, harvest or otherwise scrape any personal data of other users from the Platform;
- use the Platform to send spam, unsolicited communications, chain letters or any form of unauthorised advertising;
- reverse engineer, decompile, disassemble or otherwise attempt to derive the source code of any part of the Platform.
9. Computer Misuse Act
You acknowledge that any unauthorised access to, interference with, or modification of the Platform may constitute an offence under the Computer Misuse Act 1993 (No. 19 of 1993) of Singapore. We reserve the right to report any such conduct to the relevant law enforcement authorities and to cooperate fully with their investigations.
10. Third-Party Links and External Content
The Platform contains hyperlinks to third-party websites, donation portals, government resources and external content. Such links are provided solely for informational convenience. We do not endorse, control, monitor or assume any responsibility for the content, products, services, privacy practices or security of any third-party website. Access to and use of third-party websites is at your own risk and subject to the terms and policies of those third parties.
11. Limitation of Liability
To the maximum extent permitted by Singapore law, SGCharity.sg, its operators, contributors, agents and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages whatsoever, including but not limited to:
- loss of donations, gifts, monies, financial assets or property;
- loss of business, profits, revenue, goodwill or anticipated savings;
- loss of or damage to data, software, hardware or systems;
- damages arising from reliance on any information published on the Platform;
- damages arising from any inaccuracy, omission, error or delay in the information published;
- damages arising from interruption, suspension, termination, malfunction or unavailability of the Platform;
- damages arising from any third-party content, link, website or service accessed through the Platform;
- damages arising from any fraud, scam, misappropriation or wrongful conduct committed by any third party (including any listed charity, purported charity or unrelated fraudster).
The aggregate liability of SGCharity.sg arising out of or in connection with these Terms or your use of the Platform shall not, in any event, exceed one Singapore dollar (S$1.00).
Nothing in these Terms shall be construed as excluding or limiting our liability for: (a) fraud or fraudulent misrepresentation; (b) death or personal injury caused by our negligence; or (c) any other liability that cannot be excluded or limited under Singapore law.
12. Indemnity
You agree to indemnify, defend and hold harmless SGCharity.sg, its operators, contributors, agents and affiliates from and against any and all claims, demands, actions, suits, proceedings, liabilities, losses, damages, judgments, awards, costs and expenses (including reasonable legal fees on a full indemnity basis) arising out of or in connection with: (a) your breach of these Terms; (b) your use or misuse of the Platform; (c) your violation of any law, regulation or third-party right; or (d) any content or information you submit to the Platform.
13. No Warranties
The Platform is provided on an "as is" and "as available" basis, without any warranty or representation of any kind, whether express, implied or statutory. To the maximum extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, uninterrupted availability and security.
We do not warrant that the Platform will be free from errors, defects, viruses or harmful components, or that any defects will be corrected.
14. Suspension and Termination
We reserve the right, in our sole and absolute discretion, to suspend, restrict, modify, discontinue or terminate access to all or any part of the Platform at any time, with or without notice and without liability to you or any third party. We may also terminate your access if you breach these Terms.
Provisions of these Terms which by their nature should survive termination shall survive, including without limitation provisions relating to intellectual property, limitation of liability, indemnity, governing law and dispute resolution.
15. Changes to These Terms
We may amend, modify or replace these Terms from time to time at our sole discretion. The revised Terms will be posted on the Platform with an updated "Last Updated" date. Your continued use of the Platform after any such changes constitutes your acceptance of the revised Terms. If you do not agree to any change, you must cease using the Platform.
16. Severability
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable, that provision shall be modified to the minimum extent necessary to render it enforceable, or, if such modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
17. Waiver
No failure or delay by us in exercising any right, power or remedy under these Terms shall operate as a waiver of that right, power or remedy. No single or partial exercise of any right, power or remedy shall preclude further exercise of that or any other right, power or remedy.
18. Entire Agreement
These Terms, together with the Privacy Policy and any other policies or notices we may publish on the Platform from time to time, constitute the entire agreement between you and SGCharity.sg in respect of your use of the Platform, and supersede all prior agreements, representations, warranties and understandings, whether written or oral.
19. Third-Party Rights
Save as expressly provided, a person who is not a party to these Terms shall have no right under the Contracts (Rights of Third Parties) Act 2001 (No. 39 of 2001) of Singapore to enforce any provision of these Terms.
20. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of laws principles. Any dispute, controversy or claim arising out of or in connection with these Terms, including any question regarding its existence, validity, interpretation, performance, breach or termination, shall be subject to the exclusive jurisdiction of the courts of the Republic of Singapore.
21. Compliance with Singapore Law
You agree to use the Platform in compliance with all applicable laws of Singapore, including without limitation the Charities Act 1994, the Personal Data Protection Act 2012, the Computer Misuse Act 1993, the Copyright Act 2021, the Trade Marks Act 1998, the Protection from Harassment Act 2014, the Protection from Online Falsehoods and Manipulation Act 2019, the Penal Code 1871 and the Income Tax Act 1947, together with all subsidiary legislation made under any of the foregoing.
22. Notices
Any notice to be given by us under these Terms shall be deemed validly given when posted on the Platform or otherwise made available through means we determine appropriate.
